WARRANTS

If you fail to comply with or meet any or all of the requirements set by the court or fail to appear on your citation timely, the Judge may issue a warrant for your arrest, which will include additional fees. There are two types of warrants, Alias and Capias.  Warrants are entered into a regional computer so you will be subject to arrest at any time by a peace officer. You will need to contact the Court if you feel that a warrant for your arrest has been issued. See the descriptions below for options for each type of warrant.

Alias Warrant

An Alias warrant is a warrant in which the defendant has never made an appearance and entered a plea with the Court.  Citations that are eligible for dismissal (i.e. Failure to Maintain Financial Responsibility, Expired Motor Vehicle Registration) are still eligible for dismissal if the requirements for dismissal are met. Alias warrants may be placed on a payment by the defendant at the court office. A down payment of 1/3 of the warrant(s) total will be required to be placed on a payment plan and must be paid in cash, money order, or cashier’s check. Checks are not accepted on any warrant. The balance of the warrants will be due in 30 days. You may be granted up to 90 days extension, depending on the balance owed, but a $25.00 Time Payment Fee will be required by law on each charge. Failure to complete payment will result in a Capias Warrant being issued.
 
Alias warrants are bondable. A cash bond, surety bond, or attorney bond may be posted with the court to remove your warrant form the police department. After a bond is posted you will be set for a court date with the Judge. This is the only way Alias warrants will be set for a court date.
 
Cash Bond is cash equal to the amount owed on the warrants. The defendant may post the full amount in cash with the court to be set for a court date. Once the cash bond has been received a court date will be set for the defendant to appear.  Failure to appear at this court date will result in forfeiture of your cash bond and a guilty conviction on your driving record (if applicable).
 
Surety Bond is a paper bond posted by a Texas license bondsman. You will need to contact a bondsman for their requirements to post the bond for you. If the defendant is currently in jail the bondsman will file the bonds with the Police Department. Once the court has received the surety bonds a court date will be sent to you at the address on the bond and to your bondsman. You may appear in the court office before your court date if you wish to make payment arrangements with the court. Failure to appear at this court date will result in forfeiture of your surety bond and a warrant for your arrest to be issued.
 
Attorney Bond is a paper bond posted by a licensed attorney. You will need to contact an attorney for their requirement to post the bond for you. Once the court has received the attorney bond a court date will be sent to your attorney. You must contact your attorney for further information on your case.

Capias Warrant

A Capias warrant is a warrant that the defendant appeared, entered a plea, a judgment was entered on their case and the defendant defaulted on payment or compliance with the judgment. A Capias warrant may only be paid in full or clear by time served credit. NO payments or payment plans are allowed on Capias warrants.
